Terms and Conditions of Service

Effective Entity:
These Terms and Conditions govern the use of CCAN Radio, a platform owned and operated by Unity 314.

Article 1 – General Scope and Object of the Agreement
These Terms and Conditions (T&C) govern the relationship between you as a user and Unity 314, operating the CCAN Radio platform via https://ccanradio.goodbarber.app and the official CCAN RADIO app.

By accessing or interacting with the CCAN Radio website or app, you agree to these T&C in full. Unity 314 reserves the right to amend these terms at any time without prior notice. The latest version will always be available via the CCAN Radio website or application and will take effect upon publication.

You confirm that you are of legal age in your region or that you have obtained appropriate parental/guardian consent to use our Services. Unauthorized or illegal use of our platform is strictly prohibited.

Article 2 – Content and Intellectual Property
All content, branding, programming, and creative assets accessible via CCAN Radio are the exclusive property of Unity 314. This includes but is not limited to text, images, audio, podcasts, videos, designs, names, logos, trademarks, and original formats.

Users may not copy, modify, distribute, sublicense, or reproduce any content from CCAN Radio without prior written permission from Unity 314. The platform may contain paid or restricted content which requires registration or payment to access.

Any attempt to duplicate or mimic the structure or branding of CCAN Radio or Unity 314’s intellectual property will be treated as a violation and subject to legal enforcement.

Artist Music Submission Policy
By submitting your original music to CCAN Radio through email, form, or direct message, you grant Unity 314 (operator of CCAN Radio) a non-exclusive, royalty-free, worldwide license to:
- Broadcast your music on CCAN Radio during programming, livestreams, and digital segments.
- Include your track in curated playlists, editorial stories, countdowns, and on-air competitions.
- Use portions of your submitted music in station advertisements, promotional content, or social campaigns — only to promote your music, CCAN Radio, or the independent artist community.

You retain full ownership and copyright of your music. This agreement does not transfer any rights. You may request removal at any time.

By submitting, you confirm that:
- You are the creator of the work, or have legal permission to submit.
- Your music is distributed through a platform that collects royalties via music performance rights organizations (e.g. DistroKid, CD Baby, Tunecore, Amuse, etc.).
- CCAN Radio pays annual licensing fees to agencies such as SOCAN, enabling legal broadcasting and proper royalty tracking for every spin.

Article 3 – Subscription and Payment (Only if subscriptions are offered)
Syndicated pricing and exclusive access pricing are published before confirmation of service. Unity 314 reserves the right to update pricing at any time without notice. All in-app purchases are handled through third-party platforms (e.g., Apple, Google) and are governed by those platforms’ refund and billing policies.

Unity 314 is not responsible for purchase or refund disputes involving third-party marketplaces.

Article 4 – Registration (Only if user accounts are required)
If registration is required to access certain features, users must agree to maintain the confidentiality of their login credentials and accept liability for all activity under their account.

Article 5 – Warranties
CCAN Radio content is provided “as is” without warranties of any kind. Unity 314 does not guarantee the accuracy, completeness, or availability of content and assumes no liability for reliance on provided materials.

Article 6 – User Content & Moderation
User-submitted content (e.g., comments, chat, uploads) must comply with legal standards and our community rules. Hate speech, abuse, impersonation, malware distribution, or harassment will result in immediate account suspension or ban without compensation.

Artists submitting music must hold the rights or distribution permissions for the material submitted. Misrepresentation may result in removal or legal action.

Unity 314 reserves the right to moderate, delete, or report content that violates these terms.

Article 7 – Platform Liability
Unity 314 is not liable for outages, technical failures, malware, unauthorized use of accounts, or third-party breaches. All platform usage is at the user’s own risk.

Article 8 – Third-Party Links
External links may be provided for convenience but are not under the control of Unity 314. We assume no liability for content, terms, or privacy practices of linked websites or services.

Article 9 – Disclaimer of Warranties
Unity 314 makes no warranties regarding the uninterrupted availability or accuracy of CCAN Radio. The service may change or be removed without notice. All use is at the user’s own discretion and risk.

Article 10 – Indemnification
By using CCAN Radio, you agree to indemnify Unity 314 from any legal claims, liabilities, or losses incurred from your violation of these terms or misuse of the platform.

Article 11 – Severability
If any provision of this agreement is found unenforceable, the remainder of the agreement will remain in full effect.

Article 12 – Termination
Either party may terminate the user agreement at any time. Unity 314 reserves the right to suspend access without prior notice for violations or misuse. Termination does not relieve the user of any owed payments.

Article 13 – Governing Law and Jurisdiction
These T&C are governed by the laws of Ontario, Canada. All disputes shall be handled within that jurisdiction.
